Brownfield Clean-up Legislation Passed by Senate

The Senate today voted to approve the package of Bills that I have blogged about before.  SB 437 & SBs 1345-49 all passed with bipartisan Support (30-8 for 437, 29-9 for the others).  Next stop, the Michigan House of Representatives where an identical set of bills will likely not be taken up until after Labor Day.

If enacted into law, these bills should enable more sites where cleanups have occurred  to receive “closure” status and thereby allow their redevelopment by, among other things:

1. improving the process for achieving closure finality;
2. continuing the right to pursue self implemented cleanups;
3. creating a board to review MDNRE’s denials of closures;
4. addressing the MDNRE’s application of GSI to enable more closures to occur when surface water isn’t threatened; and
5. requiring MDNRE to report statistics on closures requested, granted and denied.
